GENERAL
INFORMATION
USEFUL PUBLIC SERVICE
aka Community Service
El Paso County,
Colorado |
If you wish to begin public
service before court order to get it out of the way, you may contact the approved
supervision agency. Courts will give credit for public service completed
after the date of offense but before sentencing. For purpose of
negotiation and potential sentencing in alcohol related traffic
cases, it is advisable to immediately commence public service.
In Colorado Springs there are approximately 700
entities where public service may be completed; you should be able to find one
of interest.
A
blanket order was issued
November 2, 2004 by the Chief Judge in El Paso County
which applies to County Court and District Court regarding sentences imposed
after December 10, 2004. Useful public service
will only be recognized if completed through the
approved
supervision agency. No credit
will be given for public service done independently. Payment of a
supervision fee is mandatory. As of February 1, 2005 the public service
supervision fee in El Paso County is $75, however that is subject to change and
may not be the current fee. The majority of the fee is deposited
with the State of Colorado for payment toward any injury sustained by a
claimant doing public service at the time of injury; similar to workmen's
compensation. You can not avoid the supervision fee; be prepared to make
full payment when you first contact the approved supervision agency. Cash
is accepted; contact the approved
supervision agency in advance regarding checks or charge cards. Additional information or current fees may be
obtained through the below agency contacts.

Club or like agency, retirement home or agency for the elderly, etc. Your work
must be volunteer, not compensated.
Prior to commencement of work at the local public service jobsite,
defendant must contact the El Paso County
approved
supervision agency, complete an
application, pay the supervision fee and receive a time sheet which can be
faxed or mailed to defendant. The time sheet must be completed and returned to
the approved supervision agency at which time a certificate of
completion will be filed with the court by the El Paso County approved
supervision agency. Courts will only accept the public service upon
receipt of a certificate of completion filed by the approved supervision
agency. |

Colorado
Counties - excluding
El Paso County
If you wish to begin public
service before court order to get it out of the way, you may contact the relevant
county supervising agency. Contact information regarding a few nearby
counties is provided above. Courts will give credit for public service completed
after the date of offense but before sentencing. For purpose of
negotiation and potential sentencing in alcohol related traffic
cases, it is advisable to immediately commence public service.
State law provides for a supervision fee of $120 which is payable (frequently
cash only) at
the time you enroll in public service. The majority of the fee is deposited
with the State of Colorado for payment toward any injury sustained by a
claimant doing public service at the time of injury; similar to workmen's
compensation. You can not avoid the supervision fee; be prepared to make
payment in full when you first contact the supervising agency.
Courts in each county adopt their own policies regarding useful public
service. Some judges, but not all, will
give credit for public service which has been completed independently in your
county of residence without use of the
supervision agency or payment of the supervision fee. Contact the
judge's clerk to determine whether credit will be given for public service done
independently or whether it must be completed through an approved public service
supervision agency. If independent public service is approved by the
particular court division in the relevant county, choose any non profit public service organization,
including but not limited to Red Cross, Goodwill, Salvation Army, Disabled
Veterans (DAV), Lions Club, Rotary, Kiwanis Club, local fire station, local
park & recreation department, YMCA - YWCA, any scouting organization, Boys
Club or like agency, retirement home or agency for the elderly, etc. Your work
must be volunteer, not compensated. I have provided
completion
forms in this website as a professional courtesy, but do not use unless
the judge in your particular case accepts public service completed independently
from the county approved supervision agency.
If you decide to accomplish public service on your own
without contacting the court or supervising agency to determine local policy and without paying the worker's
compensation fee, be advised you may not receive credit in your case now
pending. Although use of the county's approved public service
supervision agency will result in payment of of the supervision fee, the safest
course of action to ensure credit for your public service is to enroll with the
relevant approved public service
supervision agency.
For practical application information regarding out of county ticket by Colorado
resident or Colorado ticket by out of state resident, refer to the above
Application
- El Paso County. Actual mechanics may vary somewhat by county.
