In this website I have included a DMV hearing request form PDF file.  Be aware the local DMV agent will likely require that you execute a new hearing request in his or her presence.  Production and surrender of your license is required at the time of hearing request, or production of your revocation notice which indicates the officer seized your license.  I have included the hearing request because I've yellow highlighted where a driver should look to see that the officer is required to be at the hearing.  You may obtain a hardcopy & make the request at DMV Driver Control - Denver or  DMV - Colorado Springs Regional Service Center

ADMINISTRATIVE STRUCTURE OVERVIEW
COLORADO DOR & DMV

DOR is an abbreviation for Colorado Department of Revenue
        Hearing and Appeals Division is a separate agency within the DOR.  In the DOR chain of command, Hearing and Appeals not report to the DMV.
        Hearing officers are employed by DOR Hearing and Appeals Division.  If a driver is entitled to a hearing on adverse action against his / her driver's license or privilege to drive in Colorado, these hearing officers determine whether an adverse action should taken.  
        Hearing officers travel from Denver daily to staff the Colorado Springs office.  When you appear for a hearing, bear in mind the hearing officer may have faced the daily commute I-25 construction delays or heavy traffic to arrive early in the morning, or may have enjoyed the pleasure of a white-out or high winds and icy roads coming over Monument pass.  
        Hearing and Appeals Section also has hearing officers to preside over tax matters, liquor licenses or other administrative matters.  Other areas of law are not discussed here.

DMV is an abbreviation for Division of Motor Vehicles.  DMV is a separate agency within the DOR. You may also see the abbreviation MVD - Motor Vehicle Division - same thing.  Within the Colorado DMV, there are several Sections - each has it's own function
        Driver Control Section - initiates adverse actions against drivers and monitors validity of license / driving privileges - or the suspension, revocation or denial thereof.  Driver control has the power to enter a suspension, revocation or denial if mandatory under the Colorado Revised Statutes (CRS).  If the driver is entitled to a hearing, a DOR hearing officer makes the decision.
            When you have a problem with your driving privileges, this is the agency section to call.  They can inform you of what adverse action is pending or in place, and what remedial action is necessary to reinstate your Colorado driving privileges.
        Financial Responsibility Act - FRA Section - monitors compliance by drivers and vehicles motor vehicle insurance as required by the Colorado Financial Responsibility Act.  FRA Section has the power to impose an FRA suspension if a driver fails to submit evidence of insurance.  FRA Section also calls the insurance companies to verify the information you provide is accurate - in other words they check to see that your coverage hadn't lapsed on the date of an accident and you are telling the truth when you say I was insured by _____ insurance company.
        Penalty Assessment Section - imposes points against your driver's license for minor traffic infraction tickets you mail in the DMV.  In the event of a collateral attack on a previous plea of guilt remitted by mail, Courts obtain the tickets from Penalty Assessment Section.  If you incur sufficient points to cause a suspension, Driver Control Section takes action.
        Master Files Section - maintains DMV records - they don't take your driving privileges away

        DMV employees and DOR hearing officers deal with a multitude of people every day.  They won't likely be as excited as you regarding reinstatement of your driver's license or driving privileges.
            Two old sayings:
                "Please solve your problem before you contact me in order that I may better assist you."
                "Sounds like a personal problem to me."
        DMV employees and DOR hearing officers can be quite helpful if approached in a polite manner, however rude or demanding behavior won't get you very far.  
        Remember that in communicating with the Colorado DMV or DOR.
        If all else fails, take it on appeal to the District Court.

DMV Hearing Defense DMV Appeal

Driving in Colorado is a constitutionally protected privilege, but nevertheless a privilege which may be lost.  Multiple statutes can cause loss of driving privileges for different driver behavior.  Drivers are entitled to a DMV hearing.  In some circumstances the right to hearing precedes potential DMV adverse action; under other Colorado traffic laws the adverse order is entered, then the driver is provided notice of the adverse action and right to request subsequent hearing.  If hearing has been held or a DMV final order has otherwise entered and the Colorado driver's license or Colorado driving privileges have been suspended, revoked or denied, the driver's remaining recourse is appeal to the District Court.  DMV appeal is subject to a statute of limitations.  Right to appeal may be lost if the driver delays.  Upon final order in the District Court, either party make take the case on appeal to the Colorado Court of Appeals.  Refer to links for additional information.

3.  Limited Assistance.  Please do not call requesting instruction, directions, legal theory, forms completion or limited document drafting, partial representation, or an explanation of applicable law to assist you in preparation or defense of your own license hearing.  I decline.

Representation by Previous Attorney

1.  Current Attorney.  Until an order has entered withdrawing representation by an attorney, an ethical rule violation exists if counsel knowingly speaks to another attorney's client without current attorney's consent.  This ethical rule governs all attorneys.  Please do not call until after you have terminated representation by a former attorney.  DOR hearings are set quickly - continuance requests on the basis of driver delay in retaining counsel are routinely denied.  Please be aware that after other counsel's withdrawal it may be difficult for a new attorney to prepare your defense in time for hearing.  Please also be aware fees and costs will be associated with procuring DMV files or court files and coming up to speed in the case.

2.  Adequate Time.  If prospective client terminates employment of the former attorney, if sufficient time exists to adequately prepare your license defense, and if prospective client approves this attorney's fees and costs structure, attorney will likely accept representation.  This shall not constitute an offer of representation; attorney and prospective client retain discretion through first consultation.

3.  Insufficient Time.  If you've waited until the eleventh hour and there is not sufficient time to adequately prepare your defense before a driver's license hearing, please do not call.  I decline.
